1. Thank you for supporting local businesses in Hampshire and the New Forest region by ordering your groceries from Tasty Hampshire.
2. These terms and conditions cover your relationship with Tasty Hampshire Ltd (we, our, us) and all orders that you make with us. Please read these terms and conditions carefully as they affect your rights and liabilities under the law. 
3. We reserve the right to review and amend these conditions from time to time, so please continue to review the conditions of use whenever accessing or using this site
4. It is important for you to know that nothing in our terms and conditions affects your statutory rights. If you would like more information on your rights as a consumer, please contact your local Citizens Advice Bureau or Trading Standards Office.

II. Understanding these terms & conditions

By purchasing from Tasty Hampshire you accept the terms and conditions set out in this document. 
a. When we refer to “Tasty Hampshire”, “we”, “us”, or “our”, we mean Tasty Hampshire Ltd.
b. When we refer to “you” or “your” we mean you, the individual accessing our website or placing an order with us.
c. “Website” means this website, www.tastyhampshire.co.uk.
d. “Products” means the produce, products and goods available to purchase on our website.
e. “Order” means the produce, products and goods you have purchased on our website and scheduled for either a recurring or one-off delivery.
f. “Subscription order” means a recurring order you have scheduled for delivery on a specified frequency.
g. “Delivery” means the physical delivery of the order you have placed on our website.
h. “Order deadline” means the point in time by the order must be placed so the delivery can be fulfilled withing the particular cycle.

Any reliance you place on such information is therefore strictly at your own risk.

4.1.2    In no event we can accept liability for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

4.1.3 Through this website you may be able to link to other websites, which are not under the control of Tasty Hampshire. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

4.2.1    Tasty Hampshire aims to offer you the best service possible, we make no promise that our Website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us (see details under ‘CONTACT US’) and we will correct the fault as soon as we reasonably can.

4.2.2    our access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. 

4.2.3    In the event that our Website is unavailable, our usual order and cancellation deadlines apply; please notify us of changes to your order via email (info@tastyhampshire.co.uk) or one of the contact details listed under CONTACT US.

They are essential to our website working properly and let you shop with us online. Cookies also tailor the products we sell and how they are advertised to our customers, both on our website and elsewhere.

This information is about the pages you look at, any products you buy and the way you move around the site. We also set a cookie when you enter your postcode to show the products available in your area.

Google Analytics, a web analytics service provided by Google, Inc. (“Google”) helps us learn more about how people use our website and improve customer experience. None of these third parties can collect any personal data that they would be able to identify you from.

4.5.3 What are cookies used for?

Cookies used for:
• For technical purposes essential to the effective working of our website, particularly in relation to online transactions.
• To let us collect information about the browsing ands hopping habits and activities of our customers, including monitoring the success of campaigns, competitions etc.

4.5.4 How do I disable cookies?

If you want to disable cookies you need to change your website browser settings to reject cookies. How you do this will depend on your browser, so refer to your browser for help.

4.5.5 What happens if I disable cookies? 

It depends on which cookies you disable, but in general this site will not work properly if you switch cookies off. If you only disable third party cookies you can still buy from our website. If you disable all cookies, you won't be able to buy from our website.

5. Products

5.1 Many of our suppliers are independent, small-scale farmers or producers, so all products are subject to availability.
5.2 Our products are priced by unit (for example slice or packet). We show the weight price for guidance only. Due to the nature of our products the minimum and maximum weight cannot always be guaranteed. As such, products may not always meet the exact criteria stated on our website. We cannot accept liability for underweight or overweight products. The published price is the unit price. We will, however, always endeavour to meet weight expectations and the minimum weight.
5.3 All product prices are inclusive of any applicable VAT.
5.4 We regularly review the prices of our products and may change them without notice.
5.5 We take care to ensure product descriptions, pictures, prices and information are accurate. However, we cannot accept liability for any inaccuracies, errors or omissions.

6. Allergens

6.1 Whilst every precaution is taken to minimise cross contamination in the production of our food we cannot guarantee that trace elements of allergens don’t exist.
6.2 mTasty Hampshire does not produce any products in its premises, they are sourced from small-scale family businesses.
6.3 Any allergens that make up part of the ingredients of our products are stated on the product label.
6.4 While this is not anticipated, any food producer may also occasionally handle products containing any of the 14 allergens: MILK, NUTS, EGGS, NUTS, PEANUTS, FISH, CRUSTACEANS, MOLLUSCS, CEREALS, SOYA, SULPHITES, CELERY, LUPINS, MUSTARD, unless the product is certified.
6.5 If you have specific dietary requirements and/or are unsure about the suitability of any of our products then please contact Tasty Hampshire for further information; we in turn will get confirmation from the producer.

7. Registration and Account

7.1 To order from Tasty Hampshire, you need to create an account with us.
7.2 You must be at least 18 years of age (or a business operated by someone at least 18 years of age) to open an account with us.
7.3 You must ensure that the details you provide are complete and accurate, including your delivery instructions.
7.4 Any change to your details must be notified to us promptly by updating your details via your account on the website.
7.5 You will be asked to create a password as part of the online account creation process. Your password must be kept confidential and you will be responsible for all activities that occur and all orders (including those for alcohol) that are submitted under its use.
7.6 You must notify us immediately if you know or suspect that someone knows your password and recommend that it is changed immediately via the ‘log into your account’ section of our website.
7.7 We reserve the right to require that you change your password and to suspend or cancel your account where we have reason to believe there has been or could be a breach of website security.
7.8 You will receive an email notification from us of your account set-up, please keep this email for your records.
7.9 The details you provide are governed by our separate Privacy Policy.
7.10 Your account with Tasty Hampshire is not a credit account and payment will be required when your order is processed.
7.11 Tasty Hampshire is an online business. It is your responsibility (at your own cost) to obtain the necessary tools and services (computer, telephone, internet connection etc) to access and manage your Tasty Hampshire account.

8. Purchasing and Placing an Order

8.1 You may purchase products from us by using the ordering facility on our website any time after you have created an account.
8.2 To purchase products from us you must add each product to your shopping basket. If you select a set box from our Grocery Boxes page, the products will be added to your shopping basket automatically.
8.3 You may add, change, or remove any product from your shopping basket before confirming your order. You may also change product quantities before confirming your order.
8.4 Orders placed with Tasty Hampshire are subject to acceptance based upon a minimum spend. To ensure the viability of the business, we need to reserve the right to alter the existing, or introduce new, minimum spend conditions.
8.5 You must select a delivery date before confirming your order. 
8.6 All orders have a delivery charge separate to that of the cost of the products you are buying.
8.7 We will clearly tell you the cost of delivery before we ask you to make your payment. The cost of delivery, referred to as “Delivery charge”, will vary depending on your chosen delivery location, method, day or time, if applicable.
8.8 You must select how frequently you wish to receive your order before you confirm your order. 
a. If you choose “One delivery only”, your order will be delivered on your chosen delivery date where possible. 
b. If you choose “Every week” or “Every two weeks”, your first order will be delivered on your chosen delivery date. Your order will then enter a recurring delivery cycle based you the frequency you selected, and will continue to be delivered every week or every two weeks (depending on your frequency selection) on the day of the week you received your first delivery.
8.9 No order is accepted until our website displays an order confirmation message. You will receive an order confirmation email from us upon acceptance, which will list all the products you have ordered, prices, and delivery details. A contract for our sale of products to you arises on our acceptance of your order. If there are any errors in the order confirmation, please contact us as soon as possible.
8.10 Where we accept an order, we do all that we can to ensure that your order is fulfilled. Products are, however, subject to availability and market conditions and we do not always know if a Product is or will be available at the time of accepting an order. If we are unable to deliver an item you have ordered, we may offer a reasonable substitute. You may reject that substitute, and you will not be charged for it, or, if you have paid already, we will refund any amount paid for it. If we do not offer a substitute, we will remove the Product from your order so that you are not charged or, if you have paid already, we will refund you the price. We will, however, bear no liability for unavailability of Products.
8.11 The price that we charge you for the Products will be the price stated by us on the Website prior to you clicking the 'Checkout' button.
8.12    All Products offered by us are subject to seasonal changes in supply levels and supply prices. If you are a 'subscription' customer (e.g. where you choose to have repeat orders of Products) the prices for certain Products may therefore differ from the price for those Products when first ordered by you. The prices for all Products ordered on a subscription basis shall be those prices for the Products stated on our Website. We recommend that you check the Website regularly. The Website still allows you to review all the Products (and their prices) that you have already ordered from us, and make amendments and corrections to them until the deadlines published on the Website.
8.13 We sell only to end users and our Products are not for re-sale. You warrant that you shall not re-sell any of the Products.
8.14 All prices for Products are inclusive of any applicable VAT.
8.15 You must be over the age of eighteen to hold an account and purchase alcohol from Tasty Hampshire. If you have ordered alcohol from us and cannot be at home at your selected delivery time, it is your responsibility to ensure that a suitable person aged eighteen or older is there to receive the order.

9. Payment

9.1 You must ensure that Tasty Hampshire is supplied with a suitable and agreeable means by which to obtain payment. Details of how to pay can be found in the frequently asked questions of our website.
9.2 We cannot accept any liability for how long it takes the banks to process your payment and we cannot make any guarantee as to when this will be paid into our account.
9.3  We cannot deliveries to you and may cancel your account where payment(s) have been withheld. You agree to compensate us in full for all reasonable costs and expenses (including legal costs) in obtaining payments that have not been made in accordance with these terms and conditions.
9.4    In order to allow payments to be taken automatically we work with a 3rd party provider (Global Payment) to store your card details securely. These are in line with our Privacy Policy can be found separately on the website.
9.5    You must ensure you provide Tasty Hampshire with details of a valid credit or debit card. You may make changes to your payment details by updating them via your account on this website. Do not send payment card details via email.
9.6 We will take payment for one-off and subscription orders after the relevant order deadlines have passed. If you place a recurring subscription order, we will continue to take payment for each delivery after your order deadlines have passed and the order has been processed in our system.
9.7 We do not use a direct debit payment system. We use a reoccurring transaction mandate so that you don’t have to give us payment details for each delivery. By placing a subscription order, you agree to a flat rate reoccurring payment, the payment amount depends on the cost of your box at time of processing.
9.8    Your payment information is stored within our systems and we do our utmost to ensure the security of these details. Your card details are encrypted, stored and processed by a fully PCI compliant third-party provider and are inaccessible to any Tasty Hampshire staff or any other third party. We use your payment details to enable automatic payment for subscription orders. We also use Dynamic 3D Secure authentication technology to protect against fraud.
9.9    We reserve the right to suspend or cancel your order, or deliveries to you, if we are refused authority from your card issuer for payment or if a payment has been rejected by your bank. You must contact us to arrange payment and wait for that payment to go through before you can place another order.

10. Delivery Policy

10.1    We will deliver to the address stated in your Tasty Hampshire account (herein also referred to as “home”). You may also request delivery to a different address or send a gift to a different address, as long as it is within Tasty Hampshire’s delivery zone.
10.2    We reserve the right not to deliver to all locations, or not to deliver all products to all locations. 
10.3    You will be notified during the account creation process and/or at check-out if applicable, if we are unable to deliver to your chosen address. Where we are unable to deliver certain products to your address we will make them unavailable for you to order.
10.4    It is your responsibility to make suitable arrangements to receive your delivery. The delivery details section of your account is important as it allows you to leave instructions of a suitable location where your delivery can be left by our delivery partner if you are not at home to take receipt of the goods, which forms part of our contract under these terms and conditions. 
10.5    In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability, and will offer compensation at our discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. 
10.6    Tasty Hampshire is dispatching your goods in heat insulated boxes. If you are not at home to receive the delivery, it is important that you provide a suitable means (at your own cost) to keep any goods we deliver that need to be refrigerated at a temperature below 8 C until such a time as you are able to refrigerate them.
10.7    Once your delivery instructions have been followed and completed by us, you will accept that you are in possession of the delivered goods. Where the delivery instructions have been followed; we will not accept any liability for damage to, or theft of your goods, nor will we accept any liability for any incidents which may arise as a result of the theft or damage to such goods (including alcohol).
10.8    In order to maximise efficiency and reduce food miles your order will be delivered on a set day of the week (usually Friday). We will aim to keep this day fixed, however, we reserve the right to change it (either temporarily or permanently) and we will notify you of any such changes.
10.9    The time that your order is delivered on that day will vary week on week depending on traffic, weather and the number of deliveries to be made that day. If ordering regularly, you may notice that your delivery occurs at a similar time each week, however, we make no guarantee of this time and accept no liability for inconvenience or loss as a result of a deviation from it. If your order is delivered by a third party partner (such as DPD), you’ll receive a delivery window in advance on the day of delivery.
10.10    We cannot accept liability for any inconvenience or loss where we are unable to deliver to you, or deliver to you late, for reasons beyond our control (e.g. adverse weather, vehicle breakdown, traffic congestion, strike actions, supplier failures). We will of course refund you for any part of your order which is not delivered, or which has been compromised as a result of the delay.
10.11    To minimise our carbon footprint, Tasty Hampshire reserves the right not to provide a printed receipt with your delivery. You will receive a receipt in email. Your delivered goods and their value can also be viewed online via your Tasty Hampshire account.
10.12    You must inspect your goods as swiftly as possible after delivery and notify us promptly of any errors. We will refund you for any products you receive that were not ordered, are faulty, have been substituted with a product that is unacceptable to you or that were delivered without us following these terms and conditions. However, such liability will be limited to the value of the erroneous and / or undelivered goods.
10.13    You agree to wash your fruit and vegetables before eating.

11. Cancellation, return, refund, replacement terms

11.1 You may cancel your account with us at any time either in your account or emailing us from the email that is registered in your account. Suspending or cancelling your account will not affect or remove any rights or liabilities accrued up until that point and any orders submitted prior to your account cancellation will remain binding.
11.2  Tasty Hampshire may cancel your account and or any accepted orders at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
11.3 You can cancel your order either online or by email sent from your registered email address. 
11.4 Cancellations made online by 11.45pm, or by 5pm by phone or email, three days before your delivery are free. 
11.5 In exceptional circumstances and at our discretion, we can cancel orders until up to 1pm the day before your delivery but will charge a one-off sum. This is to go towards the cost of preparing your order at the farm, which happens on the day before delivery. Charges:
• £5 for orders up to £25 in value
• £10 for orders £25-50 in value
• £15 for orders £50-100 in value
• £20 for orders over £100 in value.

11.6 mWith the exclusion of perishable goods, our customers who are consumers (e.g. those ordering outside of the course of their business or trade) have the right to cancel their order at any time until the expiry of the seventh (7th) day after the date of delivery. This can be done by notifying us by email or post. We may request the return or collection of these goods and refund you the price paid for them less our reasonable costs in collecting the goods.
11.7    We want you to be completely satisfied with the products you order from us. If you have any problems, or if for any reason you are not happy with your goods, please contact us and we will do our best to resolve the situation.
11.8    Refunds or product replacements are made entirely at our discretion. Your statutory rights are not affected.

12. Complaints

If you wish to make a complaint, please contact our customer service team using the details on our Contact Us page. We will do our very best to respond to your complaint as quickly as possible.

It is important for you to know that nothing in these terms affects your statutory rights. If you would like more information on your statutory rights, contact your local Trading Standards Office (www.tradingstandards.gov.uk) or Citizens Advice Bureau (www.citizensadvice.org.uk).

13. Warranties, Liabilities & Applicable Law

13.1    Whilst Tasty Hampshire tries to ensure that material included on the Website or in any other catalogue or materials is correct, we cannot accept responsibility if, despite our endeavours, this is not the case. Without prejudice to your statutory rights, Abel & Cole may correct any inaccuracies and/or errors and we will not be responsible for any such inaccuracies and/or errors or for the results obtained from the use of such information or for any technical problems you may experience with the Website.
13.2    We warrant that the products will be of satisfactory quality and, therefore, if the Products which you purchase from us are faulty or defective you should notify us in accordance with these Terms and Conditions. We will examine the Products and, if the Products are faulty or defective we will replace the faulty or defective Products or refund the price of the faulty or defective Products.
13.3    The warranty above does not apply to faults or defects which been caused by your mis-use and/or neglect of the Products or by accidents caused while the Products are in your possession.
13.4    We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for:
• any losses which are not foreseeable by you and us when the contact for the supply and purchase of the products is formed arising in connection with the supply of Products and related services or their use by you;
• any losses which are not caused by any breach by us; or
• business or trade losses (including, without limitation, loss of profits, loss of goodwill, loss of reputation and loss of business).
13.5    Subject to the provisions set out in these T&C’s, our entire liability in connection with the contract for the supply and purchase of Products and will not exceed the purchase price of the Products in question.
13.6    Nothing in these Terms and Conditions means that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents or subcontractors is limited.
13.7    We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control such as but not limited to fire, flood, adverse weather, acts of God, strikes, labour disputes, riots, civil unrest, accident, disruption to energy supplies, equipment or supplier failure, road traffic problems, terrorism or war.
13.8    These Terms and Conditions shall be governed by and construed in accordance with the laws of England.
13.9    The English courts will have non-exclusive jurisdiction over any disputes arising under or in relation to these Terms and Conditions.

14. Promotions

14.1    We may offer certain promotions for eligible customers. 
14.2    If you have a promotional code, please ensure you enter it where prompted in the shopping basket before confirming your order. If your promotional code qualifies, your deduction and the promotional code will be displayed in the shopping basket.
14.3    You may only use one promotional code per order. Promotional codes cannot be applied retrospectively to orders that have already been placed or delivered to you.
14.4    Promotional codes and offers have no cash alternatives.
14.5    We reserve the right to cancel orders or accounts if an unauthorised promotional code is used.
14.6    We reserve the right to end offers or promotions at any time.
14.7    All our offers and promotions are subject to specific terms and conditions which are detailed when in place.
